Terms of Service

The short version: you pay monthly for credits, credits buy renders, failed renders are refunded automatically, and there are no cash refunds. The rest of this page is the detail.
The agreement
These terms are between you and Anthony D’Amico, carrying on business as Scriptbit, a sole proprietorship based in Ontario, Canada (“Scriptbit”, “we”, “us”). By creating an account or using the service, you agree to them.
You must be at least 18 years old to use Scriptbit, and you must have the authority to accept these terms on behalf of any organisation you name on the account.
Scriptbit is offered to residents of Canada and the United States. It is not offered to people in the European Economic Area or the United Kingdom.
What the service does
Scriptbit generates video from text prompts, using third-party AI models for scripting, imagery, narration, and motion. Output is produced by machine and is not reviewed by a human before you receive it.
Generative models are non-deterministic. The same prompt can produce different results, quality varies, and a model may refuse a request outright. We do not promise any particular output, level of quality, or likeness to a specific reference.
Credits
Work is priced in credits. Each plan includes a monthly credit allowance, and credits are also available as one-off top-up packs.
- Credits are not money. They have no cash value, cannot be transferred between accounts, cannot be redeemed for cash, and expire as described below.
- Plan credits do not roll over. Your balance resets to your plan’s allowance on each billing date. Unused plan credits are lost at that reset.
- Top-up credits do not expire at the reset. Packs are bought separately and stay in your balance until you spend them.
- Failed renders are refunded. Credits are reserved when a render starts and returned automatically if it fails. A failed render does not cost you credits.
- Renders that finish well under estimate are partly refunded. Every render reserves against a worst-case estimate; when actual usage comes in materially below that, the difference is returned automatically. Small variances are not refunded.
We may change credit prices for individual operations as underlying model costs change. Existing balances are not revalued when we do.
Billing and cancellation
Paid plans are billed monthly in advance through Stripe, and renew automatically until cancelled. Prices are shown on the pricing page in US dollars and exclude any tax we are required to collect.
You can cancel at any time from the billing portal. Cancellation takes effect at the end of the period you have already paid for; your plan stays active until then and drops to the Free plan afterwards.
We do not offer refunds. Subscription fees and top-up purchases are non-refundable, including for unused credits and for time remaining in a cancelled period. The automatic credit refunds described above are the mechanism for renders that fail or come in under estimate; they are returned as credits, never as cash.
If a payment fails we may retry it, and may suspend or downgrade the account if it continues to fail.
Acceptable use
You are responsible for what you ask Scriptbit to make. You may not use it to generate:
- Depictions of real, identifiable people — including public figures — without their consent, or anything presenting synthetic footage of a real person as genuine.
- Content that infringes anyone’s copyright or trademark, including brand logos, wordmarks, and packaging.
- Sexual content, sexualised depictions of any person, or any content involving minors in a sexual or unsafe context.
- Graphic violence, gore, or content that promotes self-harm.
- Content that harasses, defames, or impersonates; misinformation presented as fact; or anything unlawful in your jurisdiction or ours.
The AI providers behind the service enforce their own content policies and will refuse requests independently of us. A refusal is not a fault in the service, and credits spent reaching a refusal are handled by the refund rules above.
We may suspend or terminate an account that breaches this section, without refund.
Your content and your output
You keep whatever rights you have in the prompts and reference material you upload. You confirm you have the right to use anything you upload, including any images, footage, brand assets, or likenesses in it.
You grant us the licence needed to run the service: to store your material, send it to the AI providers listed in our Privacy Policy, and produce and deliver the output to you.
As between you and us, the output is yours to use, including commercially. Be aware that purely AI-generated work may not be protectable by copyright in Canada, the United States, or elsewhere, and that models can produce similar output for different users — we cannot promise your output is unique or that you can register it.
Your use of the output is also subject to the usage policies of the underlying model providers.
Availability
We do not promise uninterrupted service. Rendering depends on third-party model providers, and their outages, rate limits, and policy changes affect us directly. We may change, suspend, or discontinue features.
The service is provided “as is” and “as available”, without warranties or conditions of any kind, express or implied, to the fullest extent the law allows.
Liability
To the fullest extent permitted by law, our total aggregate liability arising from or relating to your use of Scriptbit is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential loss, lost profits, lost revenue, lost data, or any consequence of publishing or distributing content you generated.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that applies to you, these limits apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.
You agree to indemnify us against claims arising from your use of the service, the content you upload, or the content you generate and publish — including claims that it infringes someone’s rights.
Changes to these terms
We may update these terms. If a change materially affects your rights, we will give notice before it takes effect. Continuing to use the service after that means you accept the updated terms.
Governing law and contact
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts of Ontario, except that either of us may seek injunctive relief anywhere.
If you are a consumer, nothing in these terms takes away any right you have under applicable consumer protection law, including the Ontario Consumer Protection Act.
